Shipping policy

Important Note (US customers):
Due to ongoing changes in international trade regulations in the United States, we can no longer guarantee that orders under 800 USD will be exempt from customs fees or import taxes.
A significant change is the suspension of the $800 de minimis exemption for low-value imports, meaning all commercial goods are now subject to duties and taxes, effective August 29, 2025.
The application of these fees is entirely beyond our control.
We strongly recommend contacting your local customs office for the most accurate and up-to-date information before placing an order. Madam Nuit cannot be held responsible for any unexpected charges upon delivery.


SHIPPING FAQ:

- How long will Madam Nuit take to ship my order? An order can take between 3-6 days to be shipped. This will depend on when the order was place (working days or holidays).

- How long will I wait for my order to be delivered? This will depend on where you're buying from.

Orders from Europe will take 2-5 working days.
Orders from UK will take up to 7 working days.
Orders from Switzerland will take up to 5 working days
Orders from anywhere else in the world, can take up to 2 weeks

PLEASE, BE ADVISED: SOME ORDERS MIGHT TAKE LONGER THAN EXPECTED DEPENDING ON CUSTOMS CLEARANCE AND/OR COURIER ISSUES NOT RELATED TO MADAM NUIT. 

- How much can I expect to pay for shipping? Once again, this will depend on where you're ordering from.

Orders from within the European Union will cost 9.45€
Orders from UK will cost 15€
Orders from the rest of the world from 28.95€


- When will I pay customs fees? If you're buying from UK (and your order is above £135 including shipping), if you're buying from USA (please, contact your local customs office for more accurate information). To receive further information on custom fees for different countries, please contact us at hola@leyvastudio.es

- Can I use a pickup point or PO Boxes, Parcel Lockers or Packstations as my delivery address? Unfortunately no, we do not accept these pickup points as delivery addresses. If you were to use one of these, we would contact you via email to ask for an alternative address and the item won't be shipped until we get confirmation from you.  

- Free Shipping

If free shipping is offered (e.g. on orders over €150), it only applies if the final value of the items kept after any returns still meets the required threshold.

If, after a return, the value of the items kept falls below the qualifying threshold, the original shipping cost will be deducted from the refund amount.

- Failure to Collect the Shipment by the Consumer                                                          If the Consumer fails to collect the shipment for reasons attributable solely to them (including, but not limited to, absence at the delivery address, failure to collect the parcel from a pick-up point within the prescribed period, failure to pay customs duties or taxes, or provision of incorrect shipping information) and the parcel is returned to the Seller, the Seller shall be entitled to:

 1. Charge the Consumer the actual costs incurred in fulfilling the order, including, but not limited to,

- the original shipping cost (even if free at the time of purchase),

- the return-to-sender cost (if charged by the carrier),

- a handling fee for processing the return (as per the store’s schedule of fees).

 2. Withhold any refund until the goods have been physically received back and their condition assessed.

 3. Decline any refund or re-fulfilment where, due to the Consumer’s fault or omission, the shipment is destroyed, disposed of, or permanently seized by the carrier or customs authority (e.g., for non-payment of duties or failure to provide required paperwork).

 4. Re-ship the goods upon request only after all applicable re-shipping costs have been paid, provided the goods have been returned to the Seller intact.

EU Legal Basis

Directive 2011/83/EU on consumer rights (Arts. 18–20 on delivery and transfer of risk), as amended by Directive (EU) 2019/2161.

Directive 2000/31/EC on electronic commerce (Art. 10; seller information duties).

Directive 97/67/EC (as amended) on common rules for postal services (operator obligations and return procedures).

Regulation (EU) No 952/2013 establishing the Union Customs Code (e.g., Arts. 77, 79, 88 — liability for customs and import charges).

Directive 2013/11/EU (ADR) and Regulation (EU) 524/2013 (ODR) – out-of-court consumer dispute resolution.

Nothing in this clause shall prejudice the mandatory statutory rights of Consumers under European Union or national law.
